Mobile Game "FindTheMoney" Regulations
1. General provisions
- Game Organizer: The organizer and publisher of the mobile game "FindTheMoney"
(hereinafter: the "Game") is FindTheMoney P.S.A. with its registered office in
Warsaw (ul. Karolkowa 30, 01 - 207 Warszawa), entered into the register of
entrepreneurs as a simple joint-stock company, NIP: 5273144841.
- Scope of Application: These Regulations define the rules for using the Game made
available on mobile devices with Android (Google Play) and iOS (App Store) systems.
Each person using the Game (hereinafter: the "User") is obliged to comply with the
provisions of the Regulations.
- Technical Requirements: To use the Game, a mobile device with Internet access, an
enabled GPS location service, and (optionally) a built-in camera for augmented reality
functionality is required. The Game is provided free of charge (free-to-play), but
includes optional in-app purchases.
- Age Restriction: The Game is intended exclusively for persons who have reached
the age of 18. By starting the game, the User confirms that they are of legal age.
Persons under the age of 18 may not install or use the Game. The Organizer reserves
the right to verify the User's age at the stage of prize payment or registration (e.g., by
requesting an appropriate document).
- Acceptance of the Regulations: Installation or commencement of use of the Game is
equivalent to acceptance of these Regulations. If the User does not accept the
provisions of the Regulations, they should not use the Game. Acceptance of the
Regulations and use of the Application signify the conclusion of a license
agreement between the User and the Game Organizer. Under this agreement, the
Game Organizer grants the User a limited, non-exclusive, non-transferable, and
revocable license to use the Application solely on a device belonging to the User and
exclusively for personal, non-commercial use, in accordance with the Application's
intended purpose.
The license includes the right to install and use the Application on the User's device;
the User may not transfer the granted license or sublicense it to third parties. The User
does not acquire any ownership rights to the Application or its elements – all
copyrights and other intellectual property rights to the Application remain the property
of the Game Organizer or entities from whom the Game Organizer has obtained a
license. The license is granted free of charge and may be revoked by the Game
Organizer at any time, in particular in the event of a breach of the Regulations by the
User.
This license agreement does not limit the User's rights under applicable law, including
consumer rights. Apple Inc. and Google LLC are not parties to this license agreement
and are not responsible for the Application; any claims related to the Application
should be directed exclusively to the Game Organizer.
- Nature of the Game: The Game is for entertainment purposes and does not
constitute a game of chance within the meaning of gambling regulations. Winning
prizes in the Game depends on the User's activity, engagement, and skills (such as
perceptiveness and reaction speed), and not on chance or purchase. The Game
promotes physical activity and social integration; however, the User uses it at their
own risk. The game scenario was the subject of an Opinion from the Ministry of
Finance of the Republic of Poland, issued on July 20, 2023, under number
DAG8.6861.6.2023. The Opinion states that the game is not a gambling game, nor a
game of chance, but a game of skill.
- The Game is Free: Downloading and installing the game is free of charge and incurs
no fees. All players can use the application for free. There's no obligation to make any
in-game purchases to enjoy participating in the game.
2. Definitions
For the purposes of these Regulations, the following terms mean:

Game – a mobile location-based game "FindTheMoney," enabling Users to
search for virtual items (chests and keys)on a real-world map using GPS
location and augmented reality (AR) mode or a virtual drone.

Organizer (also: "Service Provider") – FindTheMoney P.S.A. with its
registered office in Warsaw, being the entity providing the service of access to
the Game and the founder of prizes in the Game.

User – a natural person, not conducting business activity, using the Game in
accordance with the Regulations. Only a person of legal age (18+) with full
legal capacity may be a User.

Chest – a virtual object in the Game (treasure chest) placed on the map, which
the User can find and open using the appropriate Keys. Chests may have
different categories and appear in different locations at specific time intervals
(e.g., daily or weekly), after which they disappear and are replaced by others.
The placement of Chests is not random and is done according to a scenario
created by the Game Organizer.

Key – a virtual item in the Game, necessary to open Chests. Keys come in
various types, corresponding to the categories of Chests. To open a Chest, the
User must have the correct type of Key (or a specific number of them, if
required by the given Chest). Keys can be found on the map. The player cannot
buy keys. Keys are the equivalent of loyalty points for participating in the
game - finding keys on the map is not random and is related to activity in the
game and the use of consistent methods and strategies for searching the city
map where the gameplay takes place.

Cash Prize (hereinafter: "Prize") – a cash prize (in PLN, EUR, or USD
currency) awarded to the User for opening a Chest in the Game, the value of
which is predetermined by the Organizer (different for different Chests). Prizes
do not constitute an element of any game of chance – their placement and
amount result from a planned Game scenario, not from a draw. The Prize is
obtained as a result of participation in the gameplay. The gameplay may be the
subject of transmission and publication, which means that other players and
observers can track the gameplay on the map.

Register of Won Prizes – an individual record (history) in the User's profile in
the Game, including all Cash Prizes that have been accepted by the User. This
register is for informational and record-keeping purposes (it confirms the
winning of a Prize), it is not a bank account or an electronic wallet. Funds
registered as won Prizes can be paid out to the User only under the conditions
specified in the Regulations.

Virtual Items – elements and resources in the Game that have no monetary
value outside the Game, in particular: Keys, Virtual Fuel, Virtual
Binoculars, and Sensors. Virtual items serve the gameplay (facilitate or
expand the User's possibilities), are not exchangeable for monetary equivalent,
and are not prizes.
o Virtual Fuel (hereinafter: "Fuel") – a resource consumed in the Game
to move the virtual drone on the map (virtual mode). A specific amount
of Fuel is needed for the drone to cover distance in the Game without
the User's physical movement.
o Virtual Binoculars (hereinafter: "Binoculars") – an item allowing the
User to increase the viewing range on the map in the Game (reveal
Chests and Keys within a larger radius of the current position).
o Sensor – a special virtual item that helps in locating nearby Chests
(e.g., by indicating direction or notifying about the proximity of a
Chest).

User Account – the User's profile in the Game, initially identified only by a
unique identifier assigned to the User's mobile device (anonymous account).
Until the prize payout procedure is initiated or voluntary registration occurs,
the User Account does not contain the User's personal data and remains linked
only to the device.

Registration – the provision by the User of personal data required by the
Organizer (including name, surname, contact details, and possibly other data
indicated in the Regulations) in order to create a full account and/or enable
prize payout. Registration may occur no later than when requesting the payout
of the first Prize and is a condition for receiving it.

Physical Mode – a way of playing the Game that involves the User moving in
real physical space. The User's position is determined using the device's GPS
signal, which allows for exploration of the virtual Game map through real
movement.

Virtual Drone Mode – a way of playing the Game that allows the User to
explore the map without physically moving, by controlling a virtual drone
moving on the Game map. Using this mode involves the consumption of
Virtual Fuel, and the drone's range may be limited or increased by available
resources (Fuel, Binoculars, etc.).

Viewing Range – the area marked by a circle on the map in which Keys and
Chests located on the map become visible to the User. Once revealed (found),
a Key or Chest may remain visible to the User until the end of the Game.

Collection Range – the area marked by a circle on the map in which the
automatic collection of found Keys occurs and in which it is possible to open a
Chest.

Referral Program – a system in the Game that allows the User to invite new
players via a unique code or referral link. After the invited new player meets
certain conditions (e.g., completing the tutorial or obtaining the first Chest), the
inviting User receives a reward in the Game, in accordance with the rules
described in the Regulations (e.g., Virtual Fuel and an additional Cash Prize
after the invited player reaches a set goal). Details of the Referral Program are
specified in section 6 of the Regulations.
3. Game Rules and Gameplay Mechanics
- General Gameplay : The goal of the Game is to explore a virtual map
superimposed on real terrain in search of Keys and Chests containing Cash
Prizes. The User, by moving in the real world (Physical Mode) or by controlling
a virtual drone (Virtual Mode), finds various objects on the Game map: Chests
and the Keys necessary to open them.
- Moving around the map:
- In Physical Mode, the User's position on the Game map corresponds to their
actual geographical location determined by GPS. By moving in reality, the
User moves their character in the Game. If the User is not moving on foot or
their speed of movement exceeds 12 km/h, some game functions, such as
collecting and finding keys, and finding chests, will be temporarily suspended.
- In Virtual Drone Mode, the User can control a virtual drone icon on the Game
map without physically moving. Moving the drone a certain distance costs a
certain amount of Virtual Fuel. The drone has a range limited by the available
Fuel and possibly also temporarily (e.g., the drone may operate only for a
certain time). The virtual player mode complements the physical mode.
- The User can freely switch between modes, using virtual mode, for example,
when physical access to a given location is difficult. The Game may impose
restrictions on certain activities depending on the mode (e.g., some Chests may
only be accessible in physical mode to encourage real physical activity).
- Collecting Keys: Keys appear according to a scenario on the Game map – in both
physical and virtual modes. When approaching the location of a virtual Key, it is
automatically added to the User's resources. In both physical mode and virtual
drone mode, the User operates within a viewing range and a collection range. For
a Key to be automatically added to the User's resources, the key must be within the
collection range. The User can collect any number of Keys.
- Finding Chests: Chests containing Prizes appear on the map according to a
schedule or scenario set by the Organizer (e.g., daily or weekly in new locations).
Chest locations might be in popular public city areas or selected zones, and after
a certain time, unopened Chests can disappear and reappear elsewhere.
Information about a new Chest's appearance may be sent to the User via in-Game
notifications. For a Chest to be visible to the User, it must be within
their viewing range, which is marked by a circle on the map around the User's
geographical position or their Virtual Drone's geographical position.
- Opening a Chest: To open a found Chest, the User must possess the appropriate
number of previously collected Keys that match that particular Chest.
- If the condition of possessing the Keys is met, the User can select the "Open
Chest" option. As a result of this action, the corresponding Keys are consumed
(deducted from the User's resources).
- If the required number of Keys is not available, the User cannot open the
Chest. The Chest will remain closed until the User obtains the correct Key or
until the Chest disappears from the map (if the availability time expires). The
User has the opportunity to obtain the missing Keys by exploring further areas.
Another user can open the Chest with their previously collected keys, even if
the User found the Chest earlier but did not open it.
- To open a chest, it must be within the collection range, appropriately marked
by a circle on the map.
- There is a constant relationship between the quantity of Keys held and
collected during the game and the possibility of opening a chest and obtaining
a prize. The quantity of keys needed to open a Chest is specified in the Chest's
description. The quantity of keys needed to open a chest is determined by the
Game Organizer and is an element of the game scenario. The number of
collected keys is the equivalent of loyalty program points and depends on the
User's engagement in the Game and the search strategies they use.
- By clicking on a chest, the User obtains information about the chest's contents
before opening it; specifically, the description of the chest visible to the user
will show the prize value placed in the chest and the number of keys required
to open the chest.
- Chest Contents – Cash Prize: Each Chest opened by the User may contain a
specific Cash Prize. The value of the Prize is determined by the Organizer and
can range from symbolic amounts to significant sums of money. Information
about the Prize's value in a given Chest may only be revealed when it is found
and when it is within the viewing range. A Chest once opened by a User cannot
be opened by other Game Users.
- Acceptance or Rejection of the Prize: After opening a Chest, the User will be
prompted to make a choice:
- Acceptance of the Prize: If the User wishes to accept the Prize, they must
select the option confirming acceptance (e.g., the "Accept Prize" button).
Upon acceptance, the Prize is added to the User's Register of Won Prizes,
meaning the User has acquired the right to claim this Prize under the terms
specified in the Regulations (point 8 below).
- Rejection of the Prize: The User has the right to reject the awarded Cash
Prize by selecting the "Reject Prize" option. In case of rejection, the Prize is
forfeited – it will not be paid out to the User nor added to their Register of
Won Prizes. Please note: Rejecting a Prize does not constitute its
exchange for another cash prize or equivalent. However, in exchange for
rejecting the Cash Prize, the Organizer may award the User certain Virtual
Items (e.g., additional Fuel or Binoculars) as an in-game bonus. The value and
type of these virtual items are completely independent of the monetary value
of the Prize, meaning they are not an exchange of the Prize for an item of the
same value, but merely a form of appreciation for continued participation in
the game. The User acknowledges that after renouncing the Prize, they cannot
claim its payout or exchange for cash in the future. Rejecting the prize also
means that another User may obtain this prize.
- If the User does not make any choice (neither acceptance nor rejection) within
a specified time (e.g., 5 minutes from opening the Chest – the exact limit may
be indicated in the Game interface), it will be assumed that the User rejects the
Prize, which will then be forfeited. The Game may automatically redirect the
User to further gameplay, and the unaccepted Prize will not be added to the
Register.
- Register of Won Prizes: All Cash Prizes accepted by the User are recorded in
the Register of Won Prizes. This Register includes information such as the date the
Prize was won, its gross value, and potentially the payout status. The Register serves
solely for the purpose of evidencing winnings – it is not a balance of funds that the
User can freely transfer or withdraw at any time, but merely a list of awarded Prizes
awaiting payout according to the procedure described in section 8 of these
Regulations. The Player has the right to renounce an awarded cash prize until its
payout. Such renunciation results in the loss of the right to claim that prize and
is irreversible. In the event of renunciation, the Organizer may offer the Player free
virtual items as a bonus in place of the cash prize, with the understanding that the
value of these items does not correspond to the value of the original prize.
- No Guarantee of Winning: Participation in the Game and finding a Chest does not
guarantee receiving a Prize. The number of Chests with Prizes and their values are
limited and set by the Organizer. A User may never find a Chest or may not be able to
open it (e.g., due to a lack of Keys) – this is an element of risk and challenge in the
gameplay. The Organizer does not assure a minimum number or total sum of Prizes
that the User will win.
- Additional Tasks and Game Elements: The Organizer reserves the right to introduce
additional gamification elements, tasks, or quizzes within the Game. For example,
some Prizes might depend on correctly answering a quiz question (e.g., about local
topography or sponsor knowledge) before the Prize is awarded; others might require
competition between players (e.g., a contest for the most Chests opened in a week).
Detailed rules for such additional activities will be announced within the Game (e.g.,
as separate contest regulations or announcements). Participation in them is voluntary.
- Special time-limited gameplay sessions called Events are organized in the Game, each
with a specific prize pool. Each Event may have:
- its own territorial scope – the area where the gameplay takes place (e.g., a
specific city, like Warsaw or London),
- a specified minimum and maximum number of participants – established
thresholds for the number of Players who can take part in the Event,
- a limited duration – a predetermined period during which the Event is active.
- Events can overlap in time, meaning more than one event gameplay session
can be run simultaneously. Participation in one Event does not exclude
participation in another – a Player can participate in multiple Events
simultaneously, provided they meet the participation conditions for each.
4. Virtual Items and In-App Purchases

Nature of Virtual Items: All Virtual Items (Keys, Fuel, Binoculars, Sensors,
etc.) available in the Game are part of the gameplay and have no monetary
value outside the Game. These items cannot be exchanged for cash or Cash
Prizes. They are linked to the User Account and cannot be traded outside the
official channels provided in the Game (e.g., they cannot be sold or transferred
to another player outside of mechanisms provided by the Organizer).

Obtaining In-Game Items: The primary way to acquire Virtual Items is
through active gameplay. Users can find Keyswhile exploring the map (as
described above). Other items (Fuel, Binoculars, Sensors) may be offered as
rewards for in-game achievements (e.g., completing the tutorial, daily logins,
special events) or found in specific locations on the map (at the Organizer's
discretion). The Keys collected by the User are an element of the loyalty
program for active participation in the Game.

Purchasing Items (Game Store): The Game offers an optional ability to buy
selected Virtual Items through its in-app Store. Purchasing virtual items isn't
necessary to win prizes. Players can earn prizes even if they haven't bought any
virtual items in the game. Users can acquire packages of such items (e.g., units
of Fuel, Binoculars, or Sensors) using real money via the application's
distribution platforms:
o On Android devices – through Google Play (using Google Play In-
App Billing).
o On iOS devices – through Apple App Store (using Apple In-App
Purchases)
- Currency and Pricing: All in-app purchase transactions are processed in the
User's local currency, in accordance with Google Play / App Store settings.
Neither Google Play nor the App Store are game organizers and bear no
responsibility for the game's operation, its organization, or the prizes won. The
prices of Virtual Item packages are set by the Organizer and displayed in the
Game Store. Prices include all applicable taxes (including VAT) in accordance
with the requirements of the respective store and jurisdiction. The final amount
to be paid will be shown to the User before purchase confirmation.
- Payment Process: To make a purchase, the User must have an active Google
Play or App Store account with a payment method set up. After selecting an
item for purchase and confirming the transaction (e.g., by entering a password,
fingerprint, or other authorization required by Google/Apple), the appropriate
amount will be charged by the platform operator (Google or Apple). The
Organizer does not directly collect payments from the User – the
transaction takes place between the User and the platform operator in
accordance with the Google Play / App Store terms and conditions.
- Item Delivery: Purchased Virtual Items will be assigned to the User's
Account immediately upon confirmation of successful payment by the store. In
case of delays or technical issues with the delivery of purchased items, the
User should contact the Organizer's support department (contact details in
point 11.7). The Organizer will endeavor to verify the transaction and grant the
rightful items or provide assistance in resolving the issue.
- No Refunds: Subject to mandatory legal provisions (e.g., concerning
consumer protection), after the purchase and delivery of Virtual Items,
there's no possibility of returning them or receiving a refund for the
transaction. The User acknowledges that the purchase is initiated with their
consent immediately after transaction confirmation, and therefore they lose the
right to withdraw from the contract for the purchase of digital content (in
accordance with Article 38, point 13 of the Consumer Rights Act), unless the
terms and conditions of the relevant store (Google/Apple) state otherwise. Any
complaints regarding payment processing (double charges, unauthorized
transactions, etc.) should be reported directly to the platform operator
(Google/Apple), in accordance with their procedures.
- Loss of Items: Virtual Items accumulated by the User may be lost in the event
of:
o Deletion or banning of the User Account due to a violation of the
Regulations (in such a situation, described in detail in points 7.3 and
7.4, the User loses access to all accumulated resources in the Game
without the right to cost reimbursement).
o Termination of the service (e.g., permanent closure of the Game by
the Organizer) after prior notification to Users and the expiry of a
period during which it was possible to use the possessed resources –
see point 11.5.
o Device change or reinstallation of the Game without prior linking of
the Account to an email address/social media (if such functionality has
been made available), which may result in the loss of access to
accumulated items, as an anonymous Account is linked only to one
device (see point 7.1).
- Updates and Changes to Offerings: The Organizer reserves the right to add,
remove, or modify the Virtual Items offered, their functionalities, and the
prices of packages in the Game Store. Information about significant changes
will be communicated to Users within the Game (e.g., in news or update
notes). If prices of already purchased packages change or the properties of
items acquired by the User are altered, these changes will not be retroactive –
the User retains items purchased under the previous terms, unless the change
involves a widespread game functionality update (e.g., balancing gameplay)
which may affect the operation of previously acquired items.
5. Safety, User Responsibilities, and Prohibitions
- Physical Safety: The Game uses real-world location, which means the User
must exercise particular caution while playing outdoors. The User agrees to:
o Be aware of surroundings: Do not stare solely at the device screen
while moving; pay attention to potential obstacles, traffic, other people,
and hazards that could result in an accident or injury.
o Use the Game in permitted areas: Do not enter private, prohibited, or
dangerous areas in pursuit of virtual objects. The Organizer does not
require the User to break any laws or safety rules – Chest and Key
locations are planned in publicly accessible places. However, if certain
areas at a specific gameplay location are inaccessible or risky, the User
should bypass them.
o Do not operate vehicles while playing: The User should not operate
the Game while driving a vehicle (car, bicycle, electric scooter, etc.) or
perform other activities requiring full concentration. If using the Game
while moving in a vehicle, it is recommended to stop driving while
interacting with the application or to entrust vehicle control to another
person.
o Comply with traffic laws and social norms: The Game does not
exempt from the obligation to comply with the law. The User is
prohibited from engaging in actions contrary to the law under the
pretext of achieving Game objectives (e.g., one cannot justify traffic
violations or disturbing public order by claiming the necessity of
obtaining a virtual Chest).
o Take care of personal health: The Game sometimes requires physical
exertion (walking) and continuous screen viewing. The User should
play in moderation, take breaks, hydrate, and avoid playing in extreme
conditions (e.g., extreme heat, thunderstorms) that could endanger
health. Individuals with health problems (e.g., susceptibility to injuries,
photogenic epilepsy, heart disease) should consult a doctor before
engaging in intensive outdoor gameplay.
o Use augmented reality (AR) responsibly: If the Game offers an AR
mode (using the camera to superimpose Game objects onto the camera
feed), the User should ensure that camera use does not put them in
danger (e.g., do not engage in AR near a busy street without ensuring
safety).
The Organizer is not liable for any accidents, injuries, or damages resulting
from the User's careless use of the Game or use inconsistent with the above
rules.
- Digital Security:
o Device Protection: The User is responsible for the security of their
device and login credentials (if they created an Account using
email/password or through an external account). It's recommended to
secure the device against unauthorized access (PIN, fingerprint, etc.).
o Software Updates: To maintain the security and smooth operation of
the Game, the User should keep their software (device operating system
and the Game application itself) updated to the latest version.
o Malicious Software: It is forbidden to use the Game on a device with
system security features removed (so-called "root" or "jailbreak") if this
allows bypassing Game security. The User should also ensure that they
are not using any software that may interfere with the Game's operation
(see point 5.3 – prohibition of cheats).
o Backups: If the Game provides an option to link an anonymous
Account with an email address or social media account to secure
progress (e.g., in case of phone loss), the User should consider using
this option. Otherwise, device loss or reset may result in loss of access
to the Account and progress in the Game (the Organizer may not be
able to recover anonymous Account data without assigning it to the
User's permanent data).
- Prohibited Actions (Cheating and Abuses): To ensure fair play among
all Users, the following actions are prohibited:
o Use of Bots and Automation: The User may not use any programs or
scripts that automate gameplay or perform actions in the Game without
direct human involvement (so-called bots). This includes, but is not
limited to, automatic character movement, item collection, or decision-
making in the Game.
o Emulators and Unauthorized Devices: It is forbidden to use the
Game on emulators or unofficial software environments that replicate
Android/iOS on PCs or other devices that provide an unnatural
advantage (e.g., ability to manipulate GPS, keyboard macros). The
Game is intended for use on physical mobile devices, and the use of an
emulator is treated as a violation.
o GPS Signal Manipulation (Location Spoofing): It is strictly
forbidden to use tools or methods that alter the device's geolocation to
cheat Game mechanics (GPS spoofing). This applies to both teleporting
over long distances and artificially accelerating movement (e.g.,
simulating movement at a speed unnatural for a pedestrian). Detection
of such activities by the system will result in the User being flagged as
cheating and may lead to their game being blocked.
o Reverse Engineering and Client Modifications: Decompiling,
reverse-engineering, modifying the Game application, or using
modified client versions (APK) to gain unauthorized access to systems,
items, or functions is prohibited.
o Exploiting Bugs: If the User discovers a bug or vulnerability in the
Game that could give them an advantage or unauthorized access to a
Prize/items, they are obligated to immediately report it to the Organizer
and not to exploit the bug for their own purposes. Deliberately
profiting from an exploit may result in sanctions as for cheating.
o Multiple Accounts / Smurfing: A User may only have one
Account assigned to their person. Creating multiple accounts (e.g., on
several devices) by the same person to gain additional benefits in the
Game (e.g., repeatedly using bonuses for new players, mutual referrals
in the Referral Program, transferring virtual items to each other) is
prohibited. If it is found that several Accounts actually belong to one
User, the Organizer may take the actions indicated in point 5.4.
o Violating Privacy and Order in the Game: If the Game provides
communication functions between players (chat, team creation), Users
are prohibited from publishing offensive, obscene, illegal, or infringing
content that violates the personal rights of others. In particular,
harassment, threats, impersonation, or spamming is not allowed. The
Organizer may moderate communication and remove prohibited
content, as well as impose penalties on violators.
- Penalties for Violations: In the event that the User violates the provisions of
these Regulations, especially the behaviors described as prohibited in point 5.
above, the Organizer has the right to take the following actions, at its discretion
and depending on the severity of the violation:
o User Warning: In the form of a message (push, email, or in-app
notification) informing about the detected violation and demanding
cessation of such action.
o Temporary Access Restriction: Blocking the User's access to certain
Game functionalities (e.g., virtual mode, chat) or temporarily
suspending the Account for a specified period.
o Account Deletion (Ban): Permanent blocking of access to the User's
Account and their exclusion from the Game. Along with the ban, the
User loses the right to further use the Game on that Account, as well as
losing all accumulated Virtual Items and unaccepted Prizes. In the
event that a banned Account has accepted Prizes in the Register of Won
Prizes, the Organizer may decide to forfeit them as a sanction for
violating the Regulations, especially if the violation concerned the
method of obtaining these Prizes (cheating). However, if the Prizes
were obtained legally and fairly, and the violation concerned another
aspect, the Organizer may allow the payout of previously accepted
Prizes, provided that the User contacts the Organizer and undergoes a
verification procedure (including identity verification) within 30 days
of notification of the ban. After this time, unpaid Prizes are forfeited.
o Other Legal Remedies: If the User's actions caused damage to the
Organizer (e.g., financial losses due to cheating) or other Users, the
Organizer reserves the right to take appropriate legal steps, including
claiming compensation through civil action or notifying law
enforcement agencies in case of suspected criminal activity (e.g.,
hacking, computer fraud).
The decision to apply a penalty rests with the Organizer. In particular, severe
cases of cheating (e.g., mass bots, blatant exploits) may result in an immediate
and permanent ban without warning. A User whose account has been banned
may appeal this decision by contacting the Organizer (see point 11.7);
however, the Organizer reserves the final right to resolve the matter.
- Abuse Detection System: The Game may include automated mechanisms to
monitor gameplay to detect prohibited behaviors (e.g., unnatural movement
patterns indicating GPS spoofing, logging in from multiple devices
simultaneously, activity indicating a bot). By using the Game, the User
consents to the operation of these mechanisms. The anti-cheat system's
operation is based on the analysis of technical data and in-game behavior; it
does not involve making decisions solely in an automated manner that would
produce legal effects for the User – every decision to impose a penalty (apart
from possible short-term automatic suspension for verification purposes) is
verified by Game support.
- User Responsibilities: The User agrees to use the Game in accordance with
its intended purpose, these Regulations, and applicable law. The User is
prohibited from providing unlawful content. All intellectual property rights
to the Game (including code, graphics, name) belong to the Organizer or
licensors – the User has the right to use the Game only within the permitted
use specified in the Regulations (non-commercial, non-public, without
interfering with the code). Violation of these rules may result in
consequences specified in this chapter.
6. Referral Program (Referral System)
- Essence of the Program: The Organizer may run a Referral
Program aimed at promoting the Game by having current Users invite new
players. Each registered User can obtain a unique referral code or link,
which they can share with third parties (e.g., friends). A new person who
enters the referrer's code during Game installation or the first launch will be
assigned as referred by that User (hereinafter: the "Referrer").
- Who Can Participate: The Program is intended exclusively for Users who
meet the conditions of the Regulations (active account, no block). A newly
invited person must also meet the standard conditions (18+ etc.). It's
forbidden to refer the game to yourself by creating an additional Account
(see the prohibition on multiple accounts in point 5.3). Detection of such
practices will result in the reversal of any benefits and may lead to sanctions.
- Benefits for the Referrer: For successfully referring a new player, the
Referrer can receive rewards in the Game. The currently provided bonuses
are:
o Instant Bonus (Fuel): The moment the invited person first logs into
the Game and starts playing, the Referrer receives a one-time specified
amount of Virtual Fuel added to their account (e.g., fuel for 5 km).
The exact bonus value may be given in the Referral Program's
information section within the application.
o Bonus for Invited Player's Activity (Cash Prize): If the invited new
player achieves a specific goal in the Game within a set time (e.g.,
opens at least 5 Chests within 14 days of joining, wins their first Cash
Prize, etc.), then the Referrer will receive an additional Cash Prize in
an amount determined by the Organizer (e.g., 20 PLN), awarded on
principles analogous to other Prizes in the Game (i.e., it will be added
to the Register of Won Prizes after the condition is met).
o Other Forms of Rewards: The Organizer may also introduce other
levels or types of referral rewards, such as additional Binoculars,
unique badges, or larger Cash Prizes for a specific number of
successful referrals. Current rules and reward thresholds will be
communicated within the Referral Program interface.
- Conditions for Referral Recognition: A new player will be considered
correctly referred if, during registration or code entry:
o They have not previously installed or created the Game on their
device/account (the referral applies exclusively to new Users who have
never played FindTheMoney before).
o They provide a correct and valid referral code (linked to the Referrer's
Account).
o They meet any additional conditions specified by the Organizer (e.g.,
email account registration, location enablement, etc., if such
requirements are set for the new player).
Each new User can only use one referral code when creating an Account.
Attempts to enter subsequent codes or change the code after registration are not
possible.
- Time for Meeting Conditions: Bonuses in the Referral Program may
depend on the new player performing specific actions within a certain time
(e.g., winning the first Chest within 7 days). If the invited player does not
meet the conditions within the specified deadline, the Referrer may not
receive the foreseen Cash Prize. The instant bonus itself (fuel) for a partner
joining is independent of further activity and is granted immediately upon
the invited player's registration.
- Data Accuracy: The Referrer will not receive rewards if it turns out that the
invited person provided false information during registration or violated the
Regulations (e.g., it's a multi-account of an existing player). Any abuses of
the Referral Program (such as creating fictitious accounts or registering by
unauthorized persons) will result in the reversal of granted bonuses, and in
case of serious violations – sanctions from point 5.4.
- Program Changes: The Organizer reserves the right to modify, suspend, or
terminate the Referral Program at any time. Any changes will not be
retroactive to already awarded (accepted) Cash Prizes – for example, if the
Referrer has already been credited with a Prize for the invited player meeting
the conditions, they will retain the right to its payout despite a later change
in the program. Information about changes will be communicated to Users
(e.g., in the form of an in-app message or an update to the Regulations).
7. User Account and Registration
- Anonymous Device Account: Upon installing the Game and starting
gameplay, the User automatically receives an account linked to their mobile
device (a unique identifier). At this stage, the Organizer does not require
any personal data – the Account is anonymous and primarily serves to save
game progress (collected items, won Prizes, etc.). Each anonymous account
receives a generated name or ID number in the Organizer's system, which
may be visible to the User in the settings (e.g., player ID).
- Optional Linking to Email/Portal: The Organizer may offer the option to
voluntarily set up a full User Account before the Prize payout stage by:
o Email Registration: Providing an email address and password in the
application and thereby creating an account linked to that address (and
transferring previous anonymous progress to this login).
o External Login (Social Auth): Connecting the Account with a
Google, Facebook, or other offered profile (which will allow future
logins via this channel).
Such linking is optional and serves the User's convenience (it allows regaining
access to the Account in case of device change, and may also speed up the
registration process for Prize payout by pre-fetching profile data, e.g., name). If
the User does not use this option, their Account remains anonymous until the
Prize payout request.
- Data Required for Payout: At the latest, when the User decides to
withdraw any of their accepted Cash Prizes (in accordance with the
procedure in Chapter 8), they will be required to complete full registration.
This involves providing true personal data necessary for the payout and
settlement of the Prize, in particular: first name and surname, email address
(if not provided earlier), country of tax residency, possibly residential
address, and information needed for bank transfer (e.g., bank account
number or Revolut identifier, see point 8.2). Furthermore, due to the 18+ age
restriction, the Organizer may request confirmation of the date of birth or
submission of a scanned document confirming legal age.
- The User will be asked to go through the registration process in the
application (a form to fill out) or by providing the required data via an
online form/email. Only after successful data verification by the
Organizer (e.g., checking the correctness of the account number) will it
be possible to initiate the payout of funds.
- All personal data provided during the registration process are protected
in accordance with the Privacy Policy (which is an appendix to the
Regulations). The User must consent to the processing of this data for
the purpose of payout (this consent is collected during registration).
Refusal to provide the required data or lack of consent to their
processing will prevent the Prize payout – in such a case, the User may
continue to use the Game, but the Prizes will remain unpaid until the
conditions are met.
- Account Uniqueness: Each User (natural person) can have only one
Account in the Game. Creating multiple accounts by the same person (both
anonymous and registered) is prohibited, as described as abuse in point 5.3.
An exception applies if the User loses access to a previous Account (e.g.,
phone loss without the ability to recover an anonymous account) – in such a
case, they may create a new account, but the previous one will no longer be
used (any recovery of old Prizes requires contacting the Organizer and
providing proof of ownership of that Account; if this is not possible, that
account remains abandoned).
- Account Management: The application provides account settings that
allow, among other things:
o Viewing accumulated Prizes and items.
o Modifying certain data (e.g., email address, password – if the account
has been registered).
o Setting notifications and marketing consents (separate checkboxes –
see section 9 of the Privacy Policy).
o Deleting the account (the "delete account" function – see point 11.
regarding the effects of deletion).
The availability of some of these options may be limited for anonymous accounts
(e.g., editing personal data does not apply before registration).
- Account Suspension and Deletion by the User: The User can stop using
the Game at any time. They have the right to request deletion of their
account (and thus their data) via the appropriate function in the application
or by contacting the Organizer. Account deletion is equivalent to losing
access to the entire game history, including all accumulated Virtual Items
and accepted, but unpaid Prizes, which are considered permanently lost
(the User waives claims for their payout). For this reason, if the User has
accepted Prizes in the Register, they should consider withdrawing them
(point 8) before requesting account deletion. After initiating account
deletion, the Organizer may retain selected information for the period
required by law (e.g., data on previously paid prizes for accounting purposes
- see the Privacy Policy), but the game account itself and all possibilities of
using the application will be liquidated. Starting the game again will require
creating a new account from scratch.
8. Prize Payouts and Taxes
- Payout Conditions: The User has the right to withdraw accumulated and
accepted Cash Prizes shown in their Register of Won Prizes, subject to the
following conditions:
a. The User has completed full registration and personal data verification in
accordance with point 7.3 above (including providing correct data necessary
for the transfer and confirming their identity and legal age).
b. The User has at least one Prize designated for payout in the Register. A
minimum payout amount may be set by the Organizer (e.g., the Organizer may
decide that payouts are made from a total amount of at least 20 PLN for
operational reasons) – if such a minimum amount applies, it will be indicated
in the application. In the absence of other information, the User may request
the payout of even a single Prize of any amount.
c. The User's Account is not blocked or deleted, and Prizes have not been
invalidated due to a violation of the Regulations (cf. point 5.4).
d. The User submits a payout request via the mechanism provided in the Game
(e.g., a "Withdraw Prize" button) or by providing the Organizer with a
completed payout form (a sample form is an Appendix to the Regulations).
- Payout Methods: Prizes are paid out cashlessly via transfer to the account
specified by the User. The Organizer provides the following methods:
o Bank Transfer (Traditional): The User provides the bank name and
IBAN bank account number to which the Prize amount should be
transferred. The account should be held in PLN currency or be able to
receive transfers in PLN (otherwise, the recipient's bank may convert
the currency according to its own exchange rates and fees). The User
must be the owner or authorized holder of the provided account. In the
case of a foreign account (outside Poland), the User is obliged to
provide all data necessary for international transfer (e.g., SWIFT/BIC
code of the bank, bank address, etc.).
o Revolut or other Fintech application: If the User has an account with
Revolut (or another payment service supported by the Organizer), they
can specify it as a payment reception method. For Revolut, the User
may be asked to provide the phone number associated with the Revolut
account or Revolut IBAN account details (e.g., Polish PLN IBAN, if
Revolut provides one). The Organizer reserves the right that support for
payouts via specific fintech applications may depend on service
availability and may be changed or expanded.
o No Cash Payouts: The Organizer does not provide payouts in the form
of cash, checks, or postal money orders.
- Processing Time: The Organizer will strive to process approved payouts as
quickly as possible. Typically, the Prize payout should occur within 14
business days from the day the User correctly submits the payout request
(and, if necessary, provides additional documents, such as a tax residency
certificate – see point 8.6). In special cases (e.g., the need to obtain
additional information from the User, a temporarily large number of payouts,
technical breaks), this period may be extended, about which the User will be
informed.
- Payout Amount – Prize Tax: All Prize amounts shown in the Game
are gross amounts (before any tax deduction). The net amount paid out to
the User may be reduced by a lump-sum income tax on winnings, in
accordance with applicable legal provisions. According to current Polish
law:
o Prizes with a single gross value of up to and including 2000
PLN are exempt from income tax – the User will receive the full
amount of such a Prize.
o Prizes with a single gross value above 2000 PLN are subject to a lump-
sum income tax of 10% of the Prize value (Article 30, paragraph 1,
point 2 of the PIT Act). In such a case, the Organizer, as the payer,
will deduct 10% from the Prize amount before paying it out to the
User and transfer it to the appropriate tax office. The User will receive
the remaining 90% of the Prize value as the net amount.
o If the User combines several Prizes in one payout request (e.g., 5 prizes
of 500 PLN each), each of these Prizes is considered separately for tax
exemption, provided they were won independently. This means that if a
single Prize does not exceed 2000 PLN, it is exempt, even if the total
sum paid out is larger. However, in case of doubts regarding the
interpretation of regulations or the accumulation of prizes, the
Organizer may cautiously apply a tax deduction on the excess over
2000 PLN of the total amount of payouts made at once – in such a case,
the User will be informed about the settlement method applied.
- Organizer's Tax Obligations: As the prize provider and tax remitter (in the
case of taxed Prizes), the Organizer is responsible for settling this tax with
the Polish tax authorities. After the end of the tax year in which taxed Prizes
were paid out, the Organizer will prepare and submit a collective declaration
(PIT-8AR) to the tax office concerning the collected lump-sum taxes. The
User does not receive an individual PIT-11, as the tax on winnings is a lump
sum and withheld at the source – this also means that the User (a Polish tax
resident) does not need to report such winnings in their annual PIT tax
return, provided the tax was correctly withheld by the Organizer.
- Foreign Residents – Certificate of Tax Residency: The Game is also
available to Users who are not Polish tax residents (e.g., foreigners or Poles
permanently residing abroad). If, for tax purposes, the User has a place of
residence outside Poland (non-resident) and this is relevant for the taxation
of the Prize based on the applicable double taxation treaty between Poland
and the User's country of residence, the User has the right to provide the
Organizer with a valid certificate of tax residency issued by the relevant
authority of their country.
- Providing a certificate of residency may affect how the Prize is taxed.
In particular, if the double taxation treaty provides for exclusive
taxation of winnings in the User's country of residence or their
exemption in Poland, the Organizer will not deduct the 10% tax in
Poland, or will deduct tax at the rate resulting from that treaty (if a
different withholding tax rate is provided).
- The certificate of residency should be an original or an officially
certified copy, prepared in Polish or with a translation into Polish, and
valid on the date of the Prize payout. The document should be provided
to the Organizer at the time of requesting payout (or earlier).
- If the User fails to provide a certificate of residency, the Organizer will
assume that the User is a Polish resident or that the payout is subject to
taxation under general rules in Poland – and will apply a 10% tax
deduction (if the prize value is > 2000 PLN). The User may then
independently seek a refund of the withheld tax in their own country
based on bilateral settlements, but this is not the Organizer's obligation.
- Please note: Even if the tax is not collected in Poland due to a
certificate of residency, the User may be obliged to declare the
winnings in their own country in accordance with local tax law. The
Organizer is not responsible for the User's tax obligations in their
country of residence.
- Transfer Costs: Standard costs for domestic bank transfers may be
deducted from the cash prize payout. For international bank transfers or non-
standard payment methods (e.g., SWIFT transfer outside the EU), additional
fees from intermediary banks, currency conversion charges, etc., may apply
- these costs (beyond the Organizer's control) are borne by the User. To
avoid fees, it's recommended to choose a preferred payout method from the
suggested ones (e.g., Revolut or an account with a bank branch in
Poland/EU). The Organizer does not charge any commissions on payouts
(apart from any tax deductions mentioned above).
- Payout Form and Verification: Each payout requires the User to submit an
order. If the application's functionality does not provide a fully automated
process, the User may be asked to fill out a Prize payout form (which is an
Appendix to the Regulations) and send it electronically to the Organizer's
address or via an in-app function. In this form, the User provides, among
other things: personal data, amounts and types of prizes to be paid out, the
chosen payment method, and includes required declarations (e.g., about
fulfilling the Regulations' conditions, legal age). In case of any formal
deficiencies in the payout request (e.g., missing signature, illegible data), the
Organizer will request the User to rectify them before processing the
payment. The time allowed for rectifying deficiencies may extend the payout
period.
- Refusal of Payout: The Organizer has the right to refuse the payout of a
Prize (in whole or in part) in the following cases:
o Discovery that the Prize was obtained in a manner contrary to the
Regulations (e.g., as a result of fraud, exploitation of a bug). In such a
situation, the Prize may be invalidated.
o Failure by the User to provide the required information or
documents necessary for payout within a reasonable timeframe (e.g.,
lack of identity verification, failure to provide a residency certificate if
required).
o Provision of incorrect or misleading data by the User that prevents
the transfer from being executed (e.g., incorrect account number) –
refusal applies until the data is corrected.
o Occurrence of force majeure or circumstances beyond the
Organizer's control that prevent the transfer (e.g., financial sanctions
imposed on the User's country – see point 10, or blocking of funds for
legal reasons).
The User will be informed of the refusal and its reasons. Whenever possible
(with the exception of dishonestly obtained Prizes), the Organizer will take
steps to resolve the issue and enable the payout (e.g., allow data correction,
clarify doubts). In the event of a permanent inability to pay out due to
independent reasons (e.g., sanctions), the Prize may be withheld by the
Organizer until the impediment ceases or – if that occurs – canceled, of which
the User will be informed.
- Statute of Limitations for Payout Claims: Users should request Prize
payouts promptly. If a User does not take any action to claim their payout
for an extended period (e.g., 2 years from the date the Prize was added to
the Register), the Organizer may contact the User to remind them of the
payout option. If contact is impossible (e.g., the User changed their email
address and does not log into the Game) or the User does not respond within
another year, the claim for payout of such a Prize may become time-barred.
After 3 years from the day the payout became possible (the Prize was
accepted), the Organizer has the right to consider the Prize abandoned – such
funds are forfeited to the Organizer, unless legal provisions state otherwise.
This provision does not infringe on the User's consumer rights, but merely
stems from general limitation periods for claims.
9. Personal Data Protection and Marketing Consents
- Data Controller: The data controller for Users' personal data is the
Organizer – FindTheMoney P.S.A. with its registered office in Warsaw
(address: ul. Karolkowa 30, 01-207 Warsaw). Users' personal data will be
processed in accordance with applicable legal provisions, in particular
Regulation (EU) 2016/679 of the European Parliament and of the Council
(GDPR) and the personal data protection act.
- Privacy Policy: Detailed information regarding the processing of personal
data is contained in the document Privacy Policy of the Game
"FindTheMoney", which forms an integral part of these Regulations. Every
User should familiarize themselves with the Privacy Policy. Acceptance of
the Regulations also means confirmation of having read the Privacy Policy.
- Scope of Data: During the use of the Game, the Organizer may process
various categories of User data, including:
o Data collected automatically during gameplay (e.g., GPS location
data, device identifier, IP address, game statistics).
o Data provided during registration or prize payouts (e.g., first name,
last name, email address, information needed for transfer).
o Optional contact data for marketing communications (if the User
gives consent).
All such data will be used exclusively for specified purposes, including
providing game services, prize payouts, ensuring security, and – with consent –
marketing activities.
- Marketing Consents: Within the Game, the User has the option to give
voluntary consent (by checking a separate checkbox) to receive commercial
information and marketing materials:
o From the Organizer (own marketing) – e.g., notifications about new
game features, promotions, future products of FindTheMoney P.S.A.
o And optionally from external partners cooperating with the Organizer
- e.g., information about offers from game sponsors, advertising
partners.
Not giving these consents does not affect the ability to use the Game; it only
means that the User will not receive additional marketing materials beyond
essential communications related to the Game's operation. The User can
withdraw or change given consents at any time in the account settings.
- In-Game Communication: The Organizer may send the User certain
service-related communications within the application (e.g., system
messages, information about Regulation updates, notifications about a won
prize). These types of communications do not constitute marketing
communications but are an element of the service and will be sent regardless
of marketing consents.
- Data Access by Partners: In connection with using distribution platforms
and analytical tools, certain limited data may be made available to
technological partners (e.g., Google, Apple, server providers). This will
always occur in accordance with the Privacy Policy and based on
appropriate data processing agreements or compliance with data protection
regulations (e.g., Privacy Shield, standard contractual clauses, if data is
transferred outside the EEA).
- User Rights Regarding Data: Users have specific rights, including the right
to access the content of their data, rectify it, erase it, restrict processing, the
right to data portability, and the right to object to processing based on
legitimate interest or the right to withdraw consent at any time (if processing
is based on consent). Details on how to exercise these rights and contact
information for the data protection officer/controller can be found in
the Privacy Policy.
- Data Retention: User data will be stored for no longer than is necessary to
achieve the processing purposes outlined in the Privacy Policy, taking into
account retention periods required by law (e.g., data related to prize payouts
are archived for 5 years for tax and accounting purposes).
- Account Deletion and Data: If a User requests Account deletion (in
accordance with point 7.6 of the Regulations), the Organizer will cease using
their data for game purposes. However, certain information may be retained
for the period required for legal purposes (e.g., proof of payouts, consents,
etc.). You can find more details in the Privacy Policy.
(Detailed Privacy Policy is a separate document located below the regulations.)
10. Territorial Restrictions and Sanctions
- Game Availability: The game FindTheMoney can be downloaded and
used within the territory of the Republic of Poland, European Union
countries, and other countries worldwide, subject to the provisions below
regarding sanctioned countries. The official language of the Game and the
Regulations is Polish (an English version may also be available for foreign
Users), and the applicable law is Polish law, which may affect the
availability or legality of the Game in some countries. The User is obliged to
comply with the law applicable to their location while using the Game.
- Prohibition on Use in Sanctioned Countries: Due to international legal
regulations, it is forbidden to use the FindTheMoney application within
the territory of countries subject to economic sanctions or
embargoes imposed by, among others, the United Nations, the European
Union, the United States of America, or other relevant international
organizations. This specifically includes countries such as: Cuba, Iran,
North Korea, Syria, regions of Ukraine subject to sanctions, and any
other countries where the use of this type of service would be inconsistent
with applicable regulations.
- User Declaration: By accepting these Regulations and using the Game, the
User declares that they are not located in a sanctioned country and are not
an individual listed on sanctions lists (e.g., lists of individuals excluded from
financial transactions). The User also undertakes not to make the application
available to individuals they know to be located in such countries or subject
to sanctions.
- Consequences of Violating Restrictions: If the above declarations prove to
be untrue or the User violates the prohibition on use in a sanctioned country,
the Organizer has the right to block access to the Game for such User. Any
accumulated Prizes may be withheld until the User's legal status is clarified.
The Organizer is not responsible for the inability to use the Game or
withdraw a Prize due to international sanctions and advises Users traveling
to high-risk countries to refrain from using the application in those regions.
- Export and U.S. Regulations: The mobile application may be subject to
software export and re-export control laws, including United States law. The
User undertakes not to export, re-export, or make the application available to
any entities or in any countries subject to U.S. export restrictions or other
analogous regulations. By using the Game, the User declares that they are
not located in a country subject to a U.S. embargo and that they are not an
individual on the Specially Designated Nationals (SDN) list maintained by
the U.S. Department of the Treasury or any other applicable list of persons
prohibited from accessing U.S.-origin software.
11. Final Provisions
- Contact with the Organizer: For any correspondence, remarks, complaints,
or questions regarding the Game or these Regulations, the User can contact
the Organizer:
o Registered Office Address (for traditional mail): FindTheMoney
P.S.A., ul. Karolkowa 30, 01-207 Warszawa, Poland.
o Email Address (contact): support@findthemoney.win (or another
dedicated address, if provided in the application).
o Contact Form available on the official Game website (if one exists) or
in the mobile application ("Help/Contact Us" section).
The Organizer will endeavor to respond to Users' questions and submissions
within 14 business days, and for complaints regarding the game or payouts –
no later than 30 days from the receipt of the submission.
- Complaints Regarding the Game: Users have the right to submit
complaints related to the Game's functioning, services provided
electronically by the Organizer, and the processing of Prize payouts.
Complaints should be submitted electronically (email) or in writing to the
Organizer's contact details, including at least: account identifier (User ID
or email address), a description of the event forming the basis of the
complaint, the date the problem occurred, and the desired resolution.
The Organizer will review the complaint within 30 days of its receipt and
provide the User with a response via the same method the submission was
received (unless the User indicates another preferred form). In particularly
complex cases requiring a longer investigative procedure, the Organizer will
inform the User about the anticipated longer resolution time.
- Changes to the Regulations: The Organizer reserves the right to introduce
changes to these Regulations for important reasons, including: changes in
legal provisions affecting the rights and obligations of the parties, changes in
Game functionality or scope of services, introduction of new features (e.g.,
new payout methods, currencies, game modes), the need to clarify
provisions or remove any ambiguities, changes in the Organizer's data (e.g.,
address, legal form).
o The User will be informed of every planned significant change to the
Regulations with appropriate advance notice via an in-app message
(push or upon next login) and/or by email (if the email address is
known to the Organizer).
o Changes come into effect no earlier than 7 days from the date of
notifying Users (unless legal provisions require a shorter period or
concern the introduction of a new service that does not infringe on
existing User rights). Using the Game after the changes come into
effect means acceptance of the new wording of the Regulations.
o If the User does not accept the introduced changes, they should stop
using the Game and have the right to delete their account at any time. If
changes are not accepted, but accepted Prizes are held, the User should
request their payout before the changes come into effect or within the
period indicated by the Organizer – failure to make such a request and
continued use of the Game after the changes will be treated as
acceptance.
- Governing Law and Jurisdiction: These Regulations are governed by
Polish law. For matters not covered by these Regulations, the provisions of
Polish law apply, including the Civil Code and relevant special acts. Any
disputes between the User and the Organizer will be resolved by the
competent Polish common court. If the User is a consumer residing in the
European Union, they may use out-of-court dispute resolution methods,
including the ODR (Online Dispute Resolution) platform.
- Service Continuity and Availability: The Organizer will strive to ensure
the continuous operation of the Game. Nevertheless, the possibility
of temporary suspension of the application (e.g., for maintenance,
updates) or permanent termination of Game operations due to business or
technical reasons is reserved. In the event of a planned termination of the
Game service, the Organizer will inform Users with at least 30 days'
advance notice, allowing them to withdraw any accumulated Prizes. After
the indicated period, the Game may be shut down, and unpaid Prizes will be
forfeited, unless separate communications state otherwise.
- Severability Clause:If any provision of these Regulations is deemed invalid
or ineffective under applicable law, the remaining provisions will remain in
force, and the invalid clauses will be replaced by legal norms or amended to
achieve their intended effect within the bounds of the law.
- Entry into Force of the Regulations: These Regulations come into force
on 26 May 2025 and apply to the use of the Game from that day forward.
